Can foreigners buy property?

Yes — foreigners can freely buy property in Spain. An NIE (Foreigner Identification Number) is required.

Land ownership rules

Urban and rustic land have different rules. Check the Nota Simple and verify the land registry status.

Legal process

Reservation deposit → private contract (Arras) → notary signing of escritura → registration in the Land Registry.

  • Proof of funds

Taxes and fees

ITP (transfer tax) 6–10% on resale, or VAT (IVA) 10% + AJD on new builds. Plus notary, registration and legal fees ~2–3%.
